These Terms and Conditions form the agreement between you and Artsy Craftsy ("Artsy Craftsy", "we", "us", or "our"). By accessing, browsing, registering with, or using Artsy Craftsy, you agree to be bound by these Terms and Conditions.

Individual sellers may also have their own policies and terms that apply to purchases made from their shops. Any contract for the purchase of a product is between you and the seller.

1. Definitions

Content: Any text, image, photograph, video, audio, graphic, review, listing, message, or other material made available through Artsy Craftsy.
Artsy Craftsy: The website, services, software, systems, applications, and technology that support the Artsy Craftsy marketplace.
Post: To upload, submit, publish, display, share, or otherwise make available content on Artsy Craftsy.
Product: Any item, service, digital product, or listing offered for sale on Artsy Craftsy.
Seller: Any individual or business offering products for sale through Artsy Craftsy.
Service: Any feature, marketplace function, subscription, or service provided by Artsy Craftsy.

2. Our Contract With You

You must be at least 18 years old and legally capable of entering into binding agreements to use Artsy Craftsy independently.
Artsy Craftsy operates as an online marketplace connecting buyers and sellers.
Artsy Craftsy is not the manufacturer, owner, importer, exporter, or supplier of products listed by sellers.
Our role is limited to providing the marketplace platform and facilitating transactions.
We may investigate complaints and take action where necessary to protect the marketplace and its users.
By using Artsy Craftsy, you agree to comply with these Terms and Conditions.
We may update these Terms from time to time. Continued use of the platform constitutes acceptance of any revised version.

3. Your Account and Personal Information

You are responsible for all activities carried out under your account.
You must keep your password secure and confidential.
You must notify us immediately if you suspect unauthorised access to your account.
You agree that all information supplied by you is accurate, complete, and up to date.
You must promptly update information that changes.
Failure to maintain accurate information may result in account restrictions or closure.

4. Buying Products on Artsy Craftsy

Artsy Craftsy is not responsible for fulfilling sales contracts between buyers and sellers.
Products are listed and sold directly by independent sellers.
Prices displayed are determined by sellers and may include taxes where applicable.
Discounts and promotional pricing may be offered at the discretion of sellers and Artsy Craftsy.
You are responsible for paying the listed purchase price and any applicable shipping charges.
Payment must be made in the currency displayed at checkout.
When payment is successfully completed, a legally binding contract is formed between you and the seller.
Government duties, customs charges, taxes, delays, or import restrictions are outside our control.
We may limit transactions or accounts for security, fraud prevention, or risk management purposes.

5. Payment Security

All payments are processed securely through trusted third-party payment providers such as Stripe.

Artsy Craftsy does not store your credit or debit card details.
Financial information is processed directly by the payment provider.
Payment security is managed according to the payment provider's security standards.

6. The Artsy Craftsy Promise

We aim to make buying on Artsy Craftsy a positive experience.

If a seller fails to supply an item or supplies an item significantly different from its description, we may assist in attempting to resolve the dispute.
We may communicate with both parties and review available evidence.
Where appropriate, buyers may seek assistance through their payment provider's dispute process.
Artsy Craftsy does not guarantee refunds and cannot compel a seller to provide one beyond their legal obligations.
Any assistance provided by Artsy Craftsy is discretionary and does not create a legal obligation for us to resolve disputes.

7. Consumer Rights

Nothing within these Terms excludes or limits any rights you may have under applicable consumer protection laws.

Where consumer legislation applies, buyers may be entitled to cancellation, return, refund, repair, replacement, or other remedies as provided by law.

Responsibility for complying with consumer legislation rests with the seller responsible for the product.

8. Personal Information

You are responsible for ensuring that information submitted to Artsy Craftsy is accurate and current.
We process your information in accordance with our Privacy Policy.
We may contact you regarding your account, purchases, security matters, legal notices, and service updates.
If you consent, we may send marketing communications that you can unsubscribe from at any time.
Inactive accounts may be removed in accordance with our Privacy Policy and data retention obligations.

9. User Content

Users may post reviews, comments, listings, photographs, messages, and other content through Artsy Craftsy.

You retain ownership of content you submit.
You grant Artsy Craftsy a worldwide, non-exclusive, royalty-free licence to display, reproduce, promote, and distribute your content as required to operate and market the platform.
Content posted publicly may be visible worldwide.
You are solely responsible for content you submit.
You must ensure you have all rights and permissions necessary for any content uploaded.

10. Acceptable Use Policy

You must not use Artsy Craftsy to:

Break any applicable law or regulation.
Commit fraud or assist fraudulent activity.
Upload offensive, abusive, threatening, hateful, or defamatory material.
Upload pornographic or sexually explicit content.
Harass, intimidate, stalk, bully, or harm others.
Impersonate another individual or organisation.
Distribute malware, viruses, spyware, or harmful software.
Collect personal information from other users without permission.
Upload misleading information or false claims.
Promote illegal products, services, or activities.
Attempt unauthorised access to user accounts, systems, or data.

11. Restricted Content

Artsy Craftsy reserves the right to refuse, edit, suspend, or remove content that violates these Terms.

Content must not contain:

Personal phone numbers or personal email addresses.
Private residential addresses where unnecessary.
Unauthorised external links.
Keyword stuffing or search manipulation techniques.
False, inaccurate, or misleading information.
Third-party trademarks, logos, or intellectual property used without permission.
Content exploiting, harming, or targeting minors.

12. Reporting Offensive or Illegal Content

If you believe content breaches these Terms, infringes rights, or violates applicable law, please report it to Artsy Craftsy.

We may investigate reports at our discretion.
Content may be removed temporarily or permanently during investigations.
Repeated violations may result in account restrictions or termination.
Knowingly false or malicious complaints may result in action against the complainant.

13. Website Security

You must not:

Attempt to interfere with website operations.
Probe, scan, or test platform vulnerabilities.
Attempt unauthorised access to accounts, servers, or systems.
Modify, reverse engineer, copy, or exploit platform software.
Use automated systems to scrape or extract data without permission.
Introduce viruses, malware, bots, or malicious code.

Any attempt to compromise the security of Artsy Craftsy may result in account suspension, legal action, and referral to law enforcement authorities.

14. Intellectual Property

All Artsy Craftsy branding, logos, design elements, software, and platform content remain the property of Artsy Craftsy or its licensors.

Nothing in these Terms grants permission to copy, reproduce, modify, or distribute Artsy Craftsy intellectual property without prior written consent.

15. Limitation of Liability

To the maximum extent permitted by law:

Artsy Craftsy provides its services on an "as available" and "as is" basis.
We do not guarantee uninterrupted access to the platform.
We are not responsible for losses arising from transactions between buyers and sellers.
We are not liable for product defects, delivery failures, seller conduct, or inaccurate listings.
We shall not be liable for indirect, incidental, consequential, or financial losses arising from use of the platform.

16. Account Suspension and Termination

We reserve the right to suspend, restrict, or terminate accounts where:

These Terms are breached.
Fraudulent activity is suspected.
Security risks arise.
Unlawful behaviour is identified.
Repeated complaints or policy violations occur.

17. Governing Law

These Terms and Conditions shall be governed and interpreted in accordance with the laws of England and Wales.

Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
