Seller Terms of Service

1. Definitions

In these Terms of Service, the following definitions apply:

Content: Any text, images, photographs, graphics, audio, video, advertisements, descriptions, reviews, listings, or other material posted, uploaded, displayed, transmitted, or otherwise made available through Artsy Craftsy.
Artsy Craftsy: Refers to Artsy Craftsy.co.uk and all websites, applications, services, and platforms operated by us.
Post: To upload, publish, submit, display, distribute, or otherwise make available any content on Artsy Craftsy.
Product: Any item, digital product, service, or listing offered for sale through Artsy Craftsy.
Service: Any feature, subscription, tool, functionality, or platform service provided by Artsy Craftsy, whether free or paid.

2. Our Contract

This section explains the relationship between you and Artsy Craftsy.

In exchange for the applicable subscription fee, Artsy Craftsy provides an online marketplace platform.
You operate independently as a seller and are solely responsible for your business activities.
Artsy Craftsy is not your employer, partner, agent, distributor, publisher, or joint venture participant.
By creating listings or offering products for sale, you agree to be bound by these Terms of Service.
We may update these Terms from time to time. The version published on our website at the time of use applies.
Although we are not a party to contracts between buyers and sellers, we reserve the right to remove listings where complaints, policy breaches, legal concerns, or safety issues arise.
Subject to these Terms and our policies, you may offer products and services for sale through Artsy Craftsy.

3. Your Listings

By listing products on Artsy Craftsy, you agree to:

Accept responsibility for the accuracy of all product information.
Indemnify Artsy Craftsy against claims arising from your products, listings, business activities, or conduct.
Cover reasonable administrative and legal costs arising from breaches of these Terms.
Supply products that are legal, safe, accurately described, and of satisfactory quality.
Maintain communication with buyers regarding order status and delivery.
Remove products that are unavailable or cannot be supplied.
Not relist products removed by Artsy Craftsy without written permission.

4. Delivery of Products

Physical products must be shipped using a suitable postal or courier service.
You must update the order status when an item has been dispatched.
If informed of a delivery issue, you must investigate promptly and communicate with the buyer.
Unless otherwise stated in your listing, products should normally be dispatched within three working days.
If you are unable to fulfil an order, you must issue a refund promptly in accordance with applicable consumer laws.

5. Returns and Customer Service

When handling customer enquiries and returns, you agree to:

Respond to customer communications within 48 hours where reasonably possible.
Comply with all applicable consumer protection legislation.
Provide refunds, replacements, exchanges, or other remedies when required by law.
Notify customers promptly where products become unavailable.
Follow Artsy Craftsy procedures relating to returns, disputes, and customer satisfaction.
Cooperate with investigations relating to fraud, disputes, chargebacks, or non-delivery claims.

6. The Selling Process

Artsy Craftsy is not responsible for fulfilling contracts between buyers and sellers.
Products are sold at prices chosen by you.
A contract of sale is formed when payment is successfully processed or otherwise accepted.
All sales must comply with applicable laws and regulations.
You agree to comply with buyer protection policies published by Artsy Craftsy.
If a buyer fails to complete payment, we may cancel or remove the order.
Artsy Craftsy acts solely as a marketplace platform and is not responsible for face-to-face meetings arranged between users.

7. Order Fulfilment

You will receive notification of orders through your seller account and email.
You are responsible for packaging, dispatching, and delivering products safely.
Failure to fulfil orders may lead to payment disputes, chargebacks, account restrictions, or suspension.
You must maintain adequate records to demonstrate fulfilment where required.

8. Fees and Payments

By registering as a seller, you agree to the following fee structure:

Products are sold at prices selected by you.
The Artsy Craftsy seller dashboard and selling tools are provided through your subscription plan.
Payments must be processed through approved payment providers, including Stripe where applicable.
If excessive disputes, chargebacks, fraud concerns, or policy violations occur, Artsy Craftsy may temporarily withhold services or account access while investigations are completed.
Payment processing fees charged by Stripe or other payment providers remain your responsibility.
Seller subscription fees are non-refundable except where required by law.

9. Marketing and Promotion

You grant Artsy Craftsy permission to advertise, promote, feature, reproduce, and display your listings, images, products, shop information, and branding for the purpose of operating and promoting the marketplace.

This may include use on:

Social media platforms
Email newsletters
Online advertising campaigns
Search engines
Promotional materials

10. Product Warranties

You warrant that any product offered for sale:

Is legal to sell.
Does not infringe copyright, trademark, design, or intellectual property rights.
Is not defamatory, threatening, misleading, or unlawful.
Does not violate any applicable law.
Is not intended primarily as advertising for another business or marketplace.

You further warrant that you either:

Own all necessary intellectual property rights relating to the product; or
Have obtained all permissions, licences, and authorisations required to sell and market the product.

11. How We Handle Your Content

Content posted publicly may be visible worldwide.
Customer reviews, ratings, and feedback may remain visible even if critical.
You retain ownership of content you upload.
You grant Artsy Craftsy a non-exclusive licence to display, distribute, promote, and reproduce content as part of operating the platform.
You accept responsibility for any legal consequences resulting from your content.
You must notify us immediately if your account security has been compromised.

12. Content Restrictions

You must not use Artsy Craftsy to post content that:

Violates any law or regulation.
Encourages criminal activity.
Is abusive, threatening, intimidating, violent, or defamatory.
Contains adult, pornographic, or sexually explicit material.
Promotes discrimination, hatred, or harassment.
Impersonates another person or organisation.
Contains misleading information.
Distributes malware, viruses, or harmful software.
Promotes illegal products, services, or activities.

13. Restricted Listing Content

In addition to other restrictions, listings and content must not contain:

Unauthorised external links.
Keyword stuffing or excessive repetition intended to manipulate search results.
Personal telephone numbers or personal email addresses.
Private residential addresses where unnecessary.
Third-party logos, branding, trademarks, or copyrighted materials without permission.
Misleading certifications or endorsements.

Artsy Craftsy reserves the right to edit, suspend, remove, or refuse any content that breaches these Terms, our policies, applicable laws, or the integrity of the marketplace.

14. Account Suspension and Termination

We reserve the right to suspend, restrict, or permanently close seller accounts where:

These Terms are breached.
Fraudulent activity is suspected.
Repeated customer complaints occur.
Intellectual property infringements are reported.
Illegal activities are identified.
The security or reputation of Artsy Craftsy may be at risk.

15. Limitation of Liability

Artsy Craftsy provides its services on an "as available" and "as is" basis.

To the fullest extent permitted by law, Artsy Craftsy shall not be liable for:

Loss of sales or profits.
Business interruption.
Data loss.
Third-party actions.
Product-related claims.
Indirect or consequential losses arising from use of the platform.

16. Governing Law

These Terms of Service shall be governed by and interpreted in accordance with the laws of England and Wales.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
