IP Infringement & Counterfeit Report Process
1. Purpose of This Process
To protect creators, uphold legal obligations, and maintain a safe marketplace by providing a clear, fair, and transparent method for reporting and resolving:
- Copyright infringement
- Trademark infringement
- Counterfeit goods
- Unauthorised use of designs, patterns, branding, or creative work
2. Who Can Submit a Report
Only the following may file an IP complaint:
- The rights holder (artist, designer, brand owner)
- An authorised representative (agent, lawyer, licensing manager)
3. How to Submit a Report
Reports must be submitted through the Artsy Craftsy Support Ticket System (or a dedicated “Report IP Violation” form).
Required Information
The reporter must provide:
A. Contact & Identity
- Full name
- Business name (if applicable)
- Email address
- Proof of identity (you may request ID if needed)

B. Proof of Ownership
At least one of the following:
- Copyright registration
- Trademark certificate
- Original design files or timestamps
- Website or portfolio showing original work
- Purchase receipts for branded goods (for counterfeit claims)
C. Details of the Alleged Infringement
- Link to the Artsy Craftsy listing(s)
- Seller name
- Description of how the listing infringes
- Evidence (screenshots, comparisons, etc.)
D. Legal Declaration
A statement confirming:
- The reporter is the rights holder or authorised agent
- The information provided is accurate
- They understand false claims may result in account action
4. Initial Review by Artsy Craftsy
Your internal team performs a 24–72 hour preliminary assessment:
A. Check completeness
Is all required information provided?
B. Check validity
Does the claim appear legitimate and supported by evidence?
C. Check policy alignment
Does the report fall under prohibited activities such as:
- Counterfeit goods
- Stolen or infringing designs
- Unauthorised use of trademarks
If the report is incomplete, the reporter is asked for more information before proceeding.
5. Temporary Action (If Needed)
If the claim appears credible, Artsy Craftsy may:
- Temporarily hide or disable the listing
- Pause the seller’s ability to relist the item
- Flag the account for review
6. Notification to the Seller
The seller receives a clear, neutral notification including:
- The nature of the complaint
- The listing(s) affected
- Evidence provided
- What action has been taken
- A deadline to respond (typically 5–7 days)
The seller is invited to submit:
- Counter‑evidence
- Proof of rights
- Licensing agreements
- Original design files
7. Seller Response Review
Your team evaluates:
- Whether the seller has legitimate rights
- Whether the work is original
- Whether the item is a counterfeit or unauthorised copy
- Whether the seller’s evidence contradicts the claim
If the seller does not respond by the deadline, the case proceeds based on available information.
8. Final Decision
Artsy Craftsy issues a decision:
A. If the claim is upheld
- Listing is permanently removed
- Repeat violations may result in account suspension

B. If the claim is rejected
- Listing may be reinstated
- Reporter is informed with a brief explanation
- Case is closed
9. Repeat or Severe Violations
If a seller repeatedly infringes or is found selling counterfeit goods:
- Account suspension or termination
- Removal of all related listings
- Possible reporting to law enforcement (if applicable)

Artsy Craftsy maintains internal records of:
- All reports
- Evidence submitted
- Communications
- Decisions and actions taken

To prevent misuse:
